The aim of the research is to find solutions to the theoretical problems arising from the differences in the usage of these legal terms. This issue is particularly important because understanding the differences and similarities between Fard and Wajib impacts the legal rulings. The results of the research show that the difference between Hanafi scholars and the majority scholars regarding the distinction between Fard and Wajib is a matter of terminology. According to the majority scholars, there is no difference between the two terms, while Hanafi scholars use the term &#8220;Fard&#8221; for rulings that are proven by an unequivocal (Qat&#8217;i) evidence, and &#8220;Wajib&#8221; for rulings that are proven by a probable (Zanni) evidence.
