Abstract<\/strong>
This study aims to examine the declaratory judgment as a form of lawsuits based on a potential interest. It addresses several issues, most notably the absence of a legal regulation for such claims under Jordanian legislation and the impact of this absence on the admissibility of filing the lawsuit and the possibility of it being heard before the court, in light of the opinions that accept it and those that reject it due to its lack of legal basis. It also examines the extent to which declaratory judgments align with the principle of legal certainty and the stability of legal transactions.<\/p>\n\n\n\n

The study reached several key findings, the most important of which are: <\/p>\n\n\n\n

First, the declaratory judgment can help eliminate ambiguity regarding the defendant\u2019s legal position, particularly when the defendant holds the right to approve or reject the legal relationship.<\/p>\n\n\n\n

Second, the primary purpose of such lawsuits is to avert imminent harm that may affect the plaintiff if the defendant fails to declare their legal position.<\/p>\n\n\n\n

Accordingly, the study recommends that the legislator establish a clear legal regulation for declaratory judgments, drawing on the approaches adopted in the Kuwaiti Civil Law and the French Law of Contracts.<\/p>\n\n\n\n
