Abstract<\/strong>:<\/p>\n\n\n\n

 This study presents an analytical jurisprudential approach to the issue of spending the night in Mina on the Day of Tarwiyah in light of the Fiqh of Priorities and Balancing, through an applied study on the experience of the Palestinian Hajj mission. The significance of this research lies in its treatment of a recurring contemporary practical issue that directly affects the jurisprudence of Hajj rituals and the organization of their performance. The study is guided by the central question: Was the Prophet\u2019s \ufdfa stay in Mina an independent act of worship, or a practical means of organizing the pilgrims\u2019 movement toward the greater pillar\u2014standing at \u2018Arafah?  The analysis reveals that omitting the overnight stay in Mina, when necessitated by specific circumstances, does not constitute neglect of the Sunnah nor a violation of the rites, but rather an application of the legitimate principle of facilitation in accordance with the Fiqh of Priorities. This aligns with the juristic rule of giving precedence to obligations over recommended acts, and with al-Sh\u0101\u1e6dib\u012b\u2019s methodological principle that means follow their objectives. The study concludes that the Fiqh of Balancing provides a meaningful space for ijtih\u0101d in arranging Hajj rituals in a manner that achieves equilibrium between devotion and organization. It also contributes to developing the jurisprudence of ritual management in the modern era, strengthening the presence of the Fiqh of Priorities in the practical reality of contemporary pilgrims.<\/p>\n\n\n\n
