dir=\"ltr\"><strong>Abstract&nbsp;:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\" dir=\"ltr\">This study examines the role of Shar\u012b\u02bfah-based policy in regulating financial transactions with the aim of achieving justice, transparency, and the sustainability of resources, adopting an inductive and analytical methodology.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" dir=\"ltr\">The study concludes that Shar\u012b\u02bfah-based policy represents a balanced juristic instrument that reconciles the stability of the textual sources with the flexibility required by changing realities. It is capable of accommodating contemporary developments when activated within its established u\u1e63\u016bl\u012b (legal-theoretical) constraints, thereby underscoring the need for foundational studies that enhance understanding and application of Shar\u012b\u02bfah-based policy in contemporary political and economic contexts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" dir=\"ltr\">The research further demonstrates that Shar\u012b\u02bfah-based policy is not an independent source of legislation; rather, it constitutes an ijtih\u0101d-based framework whose application must be governed by specific controls. These include non-contradiction with definitive textual evidence, consideration of legally recognized public interest rather than unrestricted utility, the realization of justice and the removal of injustice, adherence to the overarching objectives of Shar\u012b\u02bfah and the public order, as well as commitment to consultation (sh\u016br\u0101) and collective ijtih\u0101d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" dir=\"ltr\">The study also finds that employing Shar\u012b\u02bfah-based policy in the management of financial transactions is not merely a theoretical necessity, but a practical tool for achieving social and economic justice, ensuring the sustainability of resources, and safeguarding public order.
