Abstract<\/strong>:<\/p>\n\n\n\n

The study examines the dissolution of insurance companies under Yemeni law. An insurance company is regarded as a type of capital association, specifically a joint-stock company. Therefore, its dissolution is subject to the general grounds for company dissolution, while maintaining certain particularities specific to insurance companies. Their dissolution leads to their liquidation. Accordingly, this study aims to explain the causes of the dissolution of insurance companies and the legal consequences thereof under Yemeni law, employing a descriptive and analytical approach. The study is divided into two sections: the first addresses the causes of dissolution of insurance companies, while the second discusses the notification of an insurance company’s dissolution and its resulting effects. The study reveals several findings, including the broadening of legal authority granting the Minister the power to liquidate insurance companies, and the absence of legal provisions regulating Islamic Takaful insurance companies and the distribution of their funds following dissolution. The study also puts forward several recommendations, the most important of which are: the establishment of a legal framework for Islamic Takaful insurance companies to regulate their operations and the distribution of their funds after liquidation, and limiting the authority of the Minister of Economy and Industry to liquidate insurance companies only to essential cases.<\/p>\n\n\n\n
