This study examines the role of genetic fingerprinting in affirming or denying lineage, focusing on its application within the religious and civil courts of Palestinian territories in 1948. It bridges Islamic jurisprudence and modern scientific advancements, exploring the compatibility of genetic testing with Sharia principles. The research highlights the utility of genetic fingerprinting in resolving lineage disputes, especially in cases involving illegitimate children, unidentified parentage, or conflicting claims. It critically evaluates Islamic legal traditions, such as paternity through marital presumption and oaths, against contemporary methods like genetic testing. The study further investigates the divergent stances of religious and civil courts in the region, underscoring the challenges and ethical considerations surrounding genetic evidence.
