Abstract:<\/strong><\/p>\n\n\n\n

This study aims to provide a comparative analysis of civil insolvency within Islamic Sharia and civil law, focusing on the legal provisions governing the insolvent debtor and the mechanisms for protecting the rights of both creditors and debtors. It examines the concept of insolvency from both jurisprudential and legal perspectives, distinguishing it from related concepts such as commercial bankruptcy, illiquidity, and default in payment.<\/p>\n\n\n\n

The study also addresses the procedures for declaring insolvency, including its legal conditions and consequences, such as the acceleration of debts and restrictions on the debtor\u2019s financial transactions. Furthermore, it discusses the issue of imprisonment of the insolvent debtor and the imposition of legal restrictions (guardianship) under both Islamic jurisprudence and civil law, highlighting points of convergence and divergence between the two systems.<\/p>\n\n\n\n

Adopting a descriptive, analytical, and comparative approach, the study concludes that Islamic Sharia emphasizes humanitarian considerations by granting respite to the insolvent debtor, whereas civil law focuses on procedural regulation to balance the interests of creditors and debtors. The findings also indicate the need for further development in certain Arab legal systems regarding the regulation of civil insolvency.<\/p>\n\n\n\n
