Abstract<\/strong><\/p>\n\n\n\n

The heritage of our Islamic Shar\u012b\u02bfa continues to abound with treasures of knowledge and scholarship across the disciplines of jurisprudence, \u1e25ad\u012bth, prophetic biography, biographical literature, and history. The manuscript presented herein addresses a gap that is simultaneously legal-theoretical and jurisprudential in nature \u2014 a gap undertaken by the distinguished polymath \u02bfAl\u012b Afand\u012b al-\u0100qkirm\u0101n\u012b (d. 1028 AH) in a treatise he entitled: A Treatise on the Reconciliation Between the Positions of the Jurists and the Legal Theorists Regarding Supererogatory Acts<\/em>. The present work offers a critical edition of this treatise alongside a thematic study of its subject matter within the framework of the \u1e24anaf\u012b school. This constitutes the first treatise to be critically edited from among al-\u0100qkirm\u0101n\u012b’s works, and indeed represents the first collected and published biographical account of the author.<\/p>\n\n\n\n

The content of the treatise is structured around two principal questions: Is there a genuine conflict between the \u1e24anaf\u012b jurists and legal theorists regarding supererogatory acts? And does such a conflict necessarily require preponderant reasoning (tarj\u012b\u1e25), as is the case with contested jurisprudential issues? The author concludes that this apparent conflict is unfounded, and that both parties \u2014 the jurists and the legal theorists alike \u2014 although they transmitted the definition of supererogatory acts from the well-known \u1e24anaf\u012b sources, the intended meaning of supererogation is in fact broader than what either party stipulated in their respective claims.<\/p>\n\n\n\n
