Abstract
The heritage of our Islamic Sharīʿa continues to abound with treasures of knowledge and scholarship across the disciplines of jurisprudence, ḥadīth, prophetic biography, biographical literature, and history. The manuscript presented herein addresses a gap that is simultaneously legal-theoretical and jurisprudential in nature — a gap undertaken by the distinguished polymath ʿAlī Afandī al-Āqkirmānī (d. 1028 AH) in a treatise he entitled: A Treatise on the Reconciliation Between the Positions of the Jurists and the Legal Theorists Regarding Supererogatory Acts. The present work offers a critical edition of this treatise alongside a thematic study of its subject matter within the framework of the Ḥanafī school. This constitutes the first treatise to be critically edited from among al-Āqkirmānī’s works, and indeed represents the first collected and published biographical account of the author.
The content of the treatise is structured around two principal questions: Is there a genuine conflict between the Ḥanafī jurists and legal theorists regarding supererogatory acts? And does such a conflict necessarily require preponderant reasoning (tarjīḥ), as is the case with contested jurisprudential issues? The author concludes that this apparent conflict is unfounded, and that both parties — the jurists and the legal theorists alike — although they transmitted the definition of supererogatory acts from the well-known Ḥanafī sources, the intended meaning of supererogation is in fact broader than what either party stipulated in their respective claims.

الملخص
لا زال تراث شريعتنا الإسلاميَّة زاخرًا بكنوز المعارف والعلوم: فقهًا وحديثًا وسيرةً وترجمةً وتاريخًا، والمخطوط الذي بين يديك تناول ثغرةً أصوليَّة فقهيَّة في آن واحد، انبرى لها العلامة المتفنن علي أفندي الآقْكِرماني المتوفَّى سنة 1028هـ، في دراسة أسماها: (رسالةٌ في تطبيقٍ بين قولِ الفقهاءِ والأصوليِّين في النفل)، وقد قمت بتحقيقها ودراسة موضوعها ضمن المذهب الحنفيِّ، وهي تُعدُّ الرسالةُ الأولى التي يتَمُّ تحقيقها للمؤلِّف، بل وهي الترجمةُ المجموعة الأولى التي تجمع له وتُنشر V.
ومحتوى الرسالة جاء للإجابة عن تساؤلين: هل هناك تعارضٌ بين الفقهاء والأصوليِّين من الحنفيَّة في النفل؟ وهل يلزم من هذا التعارضِ الترجيحُ كما هو حال المسائل الفقهيَّة؟ وقد توصل المؤلف إلى أنَّ هذا التعارض لا يصحُّ، وأنَّ كِلا الطرفين -الفقهاء والأصوليُّون- وإنْ نقلوا معنى النفل ممَّا ورد في مشهور كتب الحنفيَّة إلا أنَّ النفل المقصود أعمُّ ممَّا قيدوه في دعواهم.
