Abstract:
This research examines the impact of neuroscientific theories on reconstructing the criterion of criminal will among perpetrators of non-violent crimes. It proceeds from the problem that the prevailing criterion of will in criminal jurisprudence is an abstract mental one, assuming a rational and free agent, whereas neuroscientific theories show that decision is the product of a complex interaction of neural, environmental, and psychological factors. The study aims to clarify the conceptual framework of these theories, analyse the concept of criminal will, reveal the specificity of non-violent crimes, and propose a composite criterion. It adopts a descriptive analytical comparative methodology. Among its main findings are that the relationship between the neural and the legal is one of complementarity rather than conflict, that reconstruction is possible through the concept of decision space, that non-violent crimes are characterised by a graduated intentional structure, that the composite criterion allows for graduated responsibility, and that it has practical implications for criminal policy and crime prevention.

المستخلص
يتناول هذا البحث أثر النظريات العصبيّة في إعادة بناء معيار الإرادة الجنائيّة لدى مرتكبي الجرائم اللاعنفية. وتنطلق من مسألة مفادها أنّ معيار الإرادة السائد في الفقه الجزائيّ معيار ذهنيّ مجرّد، يفترض فاعلًا عقلانيًّا حرًّا، في حين تُظهر النظريات العصبيّة أنّ القرار نتاج تفاعل معقّد بين مؤثّرات عصبيّة وبيئيّة ونفسيّة. وتهدف الدراسة إلى بيان الإطار المفاهيميّ لهذه النظريات، وتحليل مفهوم الإرادة الجنائيّة، والكشف عن خصوصيّة الجرائم اللاعنفية، واقتراح معيار مركّب. وتعتمد المنهج الوصفيّ التحليليّ المقارن. ومن أبرز نتائجها أنّ العلاقة بين العصبيّ والقانونيّ علاقة تكامل لا تعارض، وأنّ إعادة البناء ممكنة عبر مفهوم الفضاء القرار، وأنّ الجرائم اللاعنفية تتميّز ببنية قصديّة متدرّجة، وأنّ المعيار المركّب يسمح بتدرّج المسؤوليّة، وأنّ له آثارًا عمليّة على السياسة الجزائيّة والوقاية من الجريمة.
