Abstract
This study, entitled “Al-Qurtubi’s Methodology in Addressing Women in the Interpretation of Divorce Verses: A Jurisprudential and Exegetical Study,” examines the exegetical and jurisprudential approach adopted by Imam Al-Qurtubi in addressing women’s issues within the verses of divorce. It aims to uncover the foundations of his legal reasoning, analyze his position on women’s material and moral rights, and highlight the extent of his adherence to and independence from the Maliki school in light of evidence. The study adopts an inductive-analytical methodology by tracing the relevant verses in his work Al-Jāmiʿ li-Aḥkām al-Qurʾān, collecting and analyzing his discussions on women, while also employing a comparative approach to examine juristic opinions and his preferences, and a descriptive method to outline the features of his methodology. The research is structured into three main sections: Al-Qurtubi’s scholarly profile and exegetical method, women’s jurisprudence in divorce verses including preventive measures and material and moral rights, and his mechanisms of legal deduction and preference. The study concludes that Al-Qurtubi’s methodology is comprehensive, integrating exegesis, jurisprudence, linguistic analysis, and maqāṣid-based reasoning. He goes beyond mere transmission of opinions to engage in critical evaluation and juristic preference based on evidence. Furthermore, he emphasizes women’s material rights such as maintenance, housing, and compensation, as well as moral rights including kind treatment, protection of dignity, and prohibition of coercion. His approach is marked by juristic fairness and non-sectarianism, relying on linguistic and contextual analysis to establish rulings, thereby reinforcing the ethical and rights-based dimensions of his تفسير and offering a valuable framework for addressing contemporary family issues.

الملخص:
يتناول هذا البحث الموسوم بـ”منهج القرطبي في الحديث عن المرأة في تفسير آيات الطلاق: دراسة فقهية تفسيرية” بيان المنهج التفسيري والفقهي الذي اعتمده الإمام القرطبي في معالجته لقضايا المرأة في آيات الطلاق، وذلك من خلال الكشف عن أسس استنباطه للأحكام وتحليل موقفه من حقوق المرأة المادية والمعنوية، مع إبراز مدى تأثره بالمذهب المالكي واستقلاله عنه في ضوء الدليل. وقد اعتمدت الدراسة على المنهج الاستقرائي والوصفي والمقارن والتحليلي بتتبع مواضع آيات الطلاق في تفسيره “الجامع لأحكام القرآن” وجمع أقواله المتعلقة بالمرأة وتحليلها. وقد توزعت الدراسة على ثلاثة مباحث رئيسة تناولت معالم شخصية القرطبي ومنهجه في التفسير، وفقه المرأة في آيات الطلاق من حيث الضوابط الوقائية والحقوق المادية والمعنوية، ثم آليات الاستنباط والترجيح عنده. وتوصلت الدراسة إلى جملة من النتائج، أبرزها أن منهج القرطبي تميز بالشمول والجمع بين التفسير والفقه واللغة والمقاصد، وأنه لم يقتصر على نقل الأقوال بل مارس الاجتهاد والترجيح وفق قوة الدليل، كما أبرز عنايته بحقوق المرأة المادية كالنَّفقة والسكنى والمتعة، والمعنوية كالإحسان وستر الأسرار ومنع العضل، واتسم بالإنصاف المذهبي وعدم التعصب، مع اعتماده على التحليل اللغوي والسياق القرآني في تقرير الأحكام، بما يعزز البعد الحقوقي والإنساني في تفسيره، ويجعل منه نموذجًا صالحًا للإفادة في معالجة قضايا الأسرة المعاصرة.
