Abstract
This study addresses the issue of a defendant’s confession—as a form of legal evidence—when obtained through unlawful means, particularly by deceptive methods, whether psychological, scientific, or through the use of medical drugs. The study aims to demonstrate the prohibition in Islamic law of such illegitimate methods of extracting confessions and to establish the invalidity and inadmissibility of any confession obtained thereby.
The research examines the evidentiary value of confessions obtained through deceptive means, including psychological and scientific techniques such as blood pressure measurement devices, lie detector tests, and similar tools, as well as through the use of medical drugs and hypnosis. It also presents the opinions of Islamic jurists regarding such confessions, alongside the views of legal scholars within positive law systems in major countries.
The study concludes that extracting confessions through unlawful methods is prohibited, and that any confession obtained through such means is legally and religiously invalid and devoid of evidentiary value. It further recommends the necessity of preventing this inhumane practice, adopting all necessary measures to limit and prohibit it, except in cases of extreme necessity and under the authorization of the legitimate authority.

الملخص:
تتحدث هٰذه الدراسة عن: موضوع اعتراف المتهم – كدليل من أدلة الإثبات الشرعية- بالطرق غير المشروعة؛ المنتزعة بوسائل التحايل عليه؛ سواءً بالوسائل النفسية أو العلمية أو العقاقير الطبية. وتهدف هٰذه الدراسة: لبيان تحريم الإسلام لهٰذه الوسائل غير المشروعة لانتزاع الاعتراف، والتوصل لعدم جواز وصحة الإقرار الناتج عنها.
وقد تناولت فيه حجية الإقرار الناتج عن طريق التحايل؛ بالأساليب النفسية أو العلمية؛ من آلات قياس ضغط الدم، وجهاز فحص الكذب وغيرها، أو باستخدام العقاقير الطبية، والتنويم المغناطيسي، وبينت آراء الفقهاء في الإقرار الناتج عن هٰذه الوسائل، وآراء شراح القانون في القانون الوضعي في الدول الكبرىٰ.
واستنتجت من هٰذه الدراسة: حرمة انتزاع اعتراف المتهم بالوسائل غير المشروعة، وتهاتر وإلغاء حجية الإقرار الناتج عنها؛ شرعاً وقضاءً. وأوصيت: بضرورة منع هٰذه الظاهرة اللاإنسانية، واتخاذ كافة التدابير للحد منها وحظرها، إلا في حالات الضرورة القصوىٰ، وبأمر من إمام المسلمين.
