Abstract
This study examines the topic of “Political Challenges and Their Impact on the Enforcement of Sharia Judicial Rulings Related to Inheritance in Area (C) of the West Bank” during the period (2024–2026). It investigates the impact of the political and legal context resulting from the occupation on the effectiveness of enforcing Sharia judicial rulings, and the resulting obstacles to the realization of inheritance rights by their rightful beneficiaries. It also explores how inheritance procedures may, in some cases, move beyond their regulatory framework to become intertwined with legal and political considerations related to the protection of property rights. The study demonstrates that the Islamic inheritance system is not merely a mechanism for distributing estates, but rather a Sharia-based means for protecting financial rights and preserving ownership. However, its practical implementation in Area (C) faces several challenges, particularly those related to land registration restrictions and administrative procedures affecting the establishment of property rights. The study also concludes that Sharia judicial rulings concerning inheritance possess legal and religious authority; however, their practical effectiveness is affected by the weakness of enforcement mechanisms under the prevailing political circumstances.
The findings reveal that the challenges hindering the enforcement of inheritance rulings in Area (C) are complex in nature, combining political, administrative, and legal dimensions. This necessitates the development of protection and enforcement mechanisms through the utilization of Sharia policy tools and modern technologies, such as digital documentation and spatial data management technologies. The study recommends strengthening the role of Sharia courts beyond their traditional documentation function to become an active institution in protecting rights and ensuring the practical implementation of inheritance-related judicial rulings.

الملخص:
تناولت هذه الدراسة موضوع “التحديات السياسية وأثرها في نفاذ الأحكام القضائية الشرعية المتعلقة بالميراث في مناطق (ج) بالضفة الغربية” خلال الفترة (2024–2026م)، وذلك من خلال بحث أثر الواقع السياسي والقانوني الناشئ عن الاحتلال في فاعلية تنفيذ الأحكام القضائية الشرعية، وما يترتب على ذلك من إعاقة وصول الحقوق الإرثية إلى أصحابها، وتحول إجراءات الميراث في بعض الحالات من إطارها التنظيمي إلى مجال تتداخل فيه الاعتبارات القانونية والسياسية المرتبطة بحماية الملكية.
وبيّنت الدراسة أن نظام الميراث في الفقه الإسلامي لا يقتصر على كونه آلية لتوزيع التركات، بل يمثل وسيلة شرعية لحماية الحقوق المالية وصيانة الملكيات، غير أن تطبيقه العملي في مناطق (ج) يواجه جملة من التحديات، ولا سيما القيود المرتبطة بالتسجيل العقاري والإجراءات الإدارية المؤثرة في تثبيت الحقوق. كما توصلت الدراسة إلى أن الأحكام القضائية الشرعية المتعلقة بالميراث تتمتع بالحجية القانونية والشرعية، إلا أن فاعليتها العملية تتأثر بضعف آليات التنفيذ في ظل الظروف السياسية القائمة.
وأظهرت النتائج أن التحديات التي تواجه نفاذ أحكام الميراث في مناطق (ج) ذات طبيعة مركبة تجمع بين الأبعاد السياسية والإدارية والقانونية، الأمر الذي يستدعي تطوير آليات الحماية والتنفيذ من خلال توظيف أدوات السياسة الشرعية والتقنيات الحديثة، مثل التوثيق الرقمي وتقنيات إدارة البيانات المكانية. وأوصت الدراسة بضرورة تعزيز دور المحاكم الشرعية لتتجاوز الوظيفة التوثيقية إلى دور فاعل في حماية الحقوق وضمان تحقيق الأثر العملي للأحكام القضائية المتعلقة بالميراث.
